Terms & Conditions
These terms explain the conditions that apply when you use this Website, access a trial, purchase a training program or participate in a Carlotta Coach service.
1. Agreement and eligibility
These Terms & Conditions (“Terms”) apply to carlottacoach.com (the “Website”) and services supplied by Carlotta Coach in Sydney, Australia. By purchasing a service, registering for a trial, creating an account or participating in coaching, you agree to the Terms presented at that time.
If you are under 18, a parent or legal guardian must authorise and manage the relevant purchase, consent and onboarding process. The parent or guardian is responsible for reviewing these Terms and providing accurate information for the participant.
2. Services and availability
Carlotta Coach may provide personalised online fitness coaching, fencing performance coaching, postnatal fitness coaching, ready-made digital training programs, free app or training previews and, when expressly available, private in-person personal training.
The description, inclusions, duration, price, delivery method and eligibility requirements shown on the relevant page or checkout form part of your agreement. If information conflicts, the specific written offer accepted at purchase takes priority over general Website information, subject always to applicable law.
Services are offered only where Carlotta Coach is appropriately qualified, insured and available to deliver them. An advertised service, time or place is not confirmed until the applicable booking or purchase process is completed.
3. Free 7-day app and training trial
The free trial is a standard, non-personalised preview designed to demonstrate selected app functions, sample workouts, exercise videos and progress features. It is not personalised coaching and does not include an individual program unless expressly stated.
No payment card is required and there is no automatic paid renewal. Trial access is limited to the stated period and may end automatically. Creating repeated accounts to obtain additional trial periods, sharing access or misusing trial content is not permitted.
4. Personalised online coaching
Personalised online coaching may be offered across fitness, fencing and postnatal training. Unless a different offer is clearly displayed and accepted, the current core coaching option is supplied for 30 days for a one-off payment, with no automatic renewal.
Coaching may include onboarding, an individual training structure, exercise demonstrations, app delivery, progress tracking, check-ins, messages and reasonable program adjustments. The precise inclusions and response arrangements are those stated in the offer accepted at checkout.
Renewal requires a new purchase or express agreement. Coaching does not continue indefinitely merely because historical material remains visible in an account.
5. Ready-made training programs
A ready-made program is a pre-designed digital product and is not individual coaching. It is supplied for personal use according to the level, duration, goal and equipment described on its product page.
You are responsible for deciding whether a general program is appropriate for you and for seeking professional health advice when required. Carlotta Coach may provide general guidance about product selection, but that guidance does not convert a ready-made product into a personalised service.
Access starts and delivery is considered to begin when the program, download or app content is made available to you, subject to your rights under the Australian Consumer Law.
6. Screening, health and safety
Exercise involves inherent risk. Before participating, you may be required to complete pre-exercise screening and provide information relevant to safe service delivery. Screening is not a medical diagnosis and acceptance of a purchase does not confirm medical fitness to exercise.
Carlotta Coach may modify, postpone or decline to begin exercise services where screening indicates that further information or clearance from an appropriate healthcare professional may be needed. Where a paid service cannot begin for this reason, available pause, rescheduling or refund options will be handled reasonably, according to the client’s preference where practicable, the Refund & Cancellation Policy and applicable law.
7. Client responsibilities
You agree to:
- provide accurate, current and relevant information;
- report injuries, pain, symptoms, pregnancy or postnatal considerations, medical restrictions and meaningful health changes;
- exercise within your ability, follow safety instructions and use suitable space and equipment;
- stop exercising and seek appropriate assistance if you experience a concerning symptom;
- obtain medical or allied-health advice when recommended or reasonably required;
- keep account credentials secure and check service-related messages; and
- communicate respectfully and not misuse Website, app or coaching channels.
For a child or young person, the parent or guardian must provide required consent, disclose relevant information and supervise participation where instructed.
8. Trainerize and third-party platforms
Trainerize may be used for accounts, program delivery, videos, bookings, tracking, check-ins and coaching communication. Payments may be processed by Stripe or another disclosed provider. Links or embedded content may also connect to Google, YouTube or other services.
Your use of an external platform is also governed by that provider’s terms and privacy practices. Carlotta Coach does not control third-party outages, technical changes or security systems. If a material platform problem prevents delivery, we will take reasonable steps to restore access, offer an appropriate alternative or provide a remedy required by law.
9. Prices, currency and payment
Prices are displayed in Australian dollars (AUD) unless clearly stated otherwise. Any EUR or USD amount shown for convenience is indicative; your payment provider may apply its own exchange rate or fee.
Payment is required according to the checkout terms before paid access or service delivery begins. You authorise the payment processor to charge the amount displayed and accept that complete card details are handled by the payment provider rather than stored by Carlotta Coach.
Unless an offer expressly states otherwise, one-off purchases do not renew automatically. Prices may change for future purchases, but a change will not retrospectively alter a completed purchase.
10. Bookings, lateness, cancellations and refunds
Rules for appointment notice, rescheduling, lateness, missed sessions, service cancellation, digital access and refunds are set out in the Refund & Cancellation Policy and any specific booking information displayed before purchase.
A booking is confirmed only when it appears as confirmed in the applicable booking system or is confirmed in writing. Weather, safety, illness, venue access or circumstances outside reasonable control may require a session to be moved, adapted or rescheduled.
Nothing in a cancellation policy removes a remedy or consumer guarantee that cannot lawfully be excluded.
11. Account access and intellectual property
Programs, workouts, videos, written instructions, downloads, forms, check-ins, branding and coaching materials are owned by Carlotta Coach or used with permission. Purchase grants you a limited, personal, non-transferable licence to use the supplied content for your own training.
You must not share accounts, copy, record, reproduce, publish, resell, distribute, upload, adapt or commercially exploit the content without written permission. Reasonable technical or account restrictions may be used to protect access and intellectual property.
Access may end when a time-limited service or trial expires. Any longer access period expressly promised for a ready-made program remains subject to platform availability, these Terms and applicable consumer rights.
12. Results and limits of the service
No particular fitness, weight, body-composition, health, fencing or competition result is guaranteed. Outcomes depend on factors including participation, consistency, training history, health, recovery, sleep, nutrition, stress, environment and individual response.
Website articles, videos and social content provide general education and do not replace individual professional advice. Testimonials and examples describe individual experiences and are not promises that another person will achieve the same result.
To the extent permitted by law, Carlotta Coach is not responsible for loss caused by inaccurate information supplied by a participant, unsafe use, disregard of instructions or events outside reasonable control. This clause does not exclude liability or rights that cannot legally be excluded.
13. Australian Consumer Law
Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, a failure may entitle you to have a problem rectified, cancel a service, receive a refund for an unused portion or reduced value, or obtain compensation for reasonably foreseeable loss or damage.
Nothing in these Terms or another Carlotta Coach policy excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded. Contractual change-of-mind and cancellation rules operate in addition to those rights.
14. Suspension, refusal or termination
Carlotta Coach may reasonably refuse, pause or terminate access where payment fails, these Terms are materially breached, content or accounts are shared, information is deliberately misrepresented, behaviour is abusive, service delivery becomes unsafe, or the client’s needs fall outside the scope of the service.
Where reasonably possible, we will explain the concern and allow an appropriate issue to be corrected. Any financial outcome will consider services already supplied, the reason for termination, the Refund & Cancellation Policy and applicable law.
15. Privacy, changes and governing law
Personal information is handled according to the Privacy Policy and cookies according to the Cookie Policy.
We may update these Terms for future use when services, platforms or legal requirements change. Material changes affecting an active paid service will be communicated where reasonably practicable and will not remove accrued statutory rights.
If any provision is unenforceable, the remaining provisions continue to operate to the extent permitted by law. A delay in enforcing a right is not a waiver of that right.
These Terms are governed by the laws of New South Wales, Australia. Courts with lawful jurisdiction may hear a dispute; this clause does not prevent a consumer from relying on a jurisdiction or right available under applicable law.
